POSITION SUMMARY

The Human Resources and Compliance Manager guides and manages the overall provision of Human Resources services, policies and programs for Acera Surgical. The Human Resources and Compliance Manager will report to the Chief Operating Officer and is responsible for managing recruiting/staffing, performance management processes, compliance with laws and company policy (including human resources and applicable healthcare laws and regulations), employee relations, employee orientation/development/training, compensation and benefits administration, employee safety / welfare / health, consistent with Acera’s corporate mission and values.

RESPONSIBILITIES

• Leads the coordination/ administration of human resource programs including, but not limited to, compensation, benefits, and leave; disciplinary matters; disputes and investigations; performance and talent management processes; productivity, recognition, and morale; occupational health and safety; training and development; and reporting/records retention. Provides necessary education and materials to managers and employees including internal or external training/workshops, manuals, employee handbooks, and standardized reports.
• Monitors and ensures the organization’s compliance with federal, state, and local employment laws and regulations (including EEO, ADA, FMLA, ERISA, OSHA and others) and recommended best practices; reviews and modifies policies and practices to maintain compliance.
• Monitors and ensures the organization’s compliance with federal and state healthcare laws and regulations related to applicable healthcare laws and regulations (e.g., HIPAA, Open Payments reporting, Stark Law), working in coordination with Acera’s Chief Compliance Officer to create/update policies and guidelines, to ensure adequate training of employees and independent sales consultants, and to monitor compliance and take corrective actions as needed.
• Identifies staffing and recruiting needs; develops and executes best practices for hiring and talent management. Works with immigration attorney, as needed.

• Responsible for new employee orientation / onboarding.

• With assistance from Finance, obtains cost-effective, employee serving benefits through PEO or other mechanisms; monitors market for options and cost savings. Recommends changes in benefits offered as part of hiring/talent management strategy.
• Manages/implements HR software and tools to efficiently manage department
• Prepares / maintains reports to carry out functions of department and for management, as requested, to track strategic and tactical goal accomplishment. Conducts research and analysis of organizational trends.
• Maintains knowledge of trends, best practices, regulatory changes, and new technologies in human resources, talent management, and employment law; applies this knowledge to communicate changes in policy, practice, and resources to upper management.
• Works with the executive team to monitor/update the compensation structure, including variable pay structures, raises, compensation levels to recruit and retain high-performing employees.

• Prepares and manages operating budgets for human resources

• Manages the development and maintenance of the Human Resources aspect of Acera’s online presence.

• Performs other duties or responsibilities as required.

QUALIFICATIONS

· Bachelor’s degree in Human Resources, Business Administration, or related field required; Master’s degree preferred.

· Five or more years of human resource leadership experience required, with strong preference for leadership of HR department at a small, fast-growing organization. 10 years of progressive leadership experience in Human Resources positions preferred.

· Experience with compliance laws/guidelines/regulations as they relate to human resources and the healthcare industry.

· Possess ongoing affiliations with leaders in successful companies, organizations, and/or networks that practice effective Human Resources Management.

· Certification from recognized industry leader (e.g., SHRM-CP, SHRM-SCP) preferred.

• Broad knowledge and experience in employment law, compensation, organizational planning, organization development, employee relations, safety, and training and development.
• Above average oral and written communication skills.
• Excellent interpersonal and coaching skills.
• Demonstrated ability to lead cross-functionally.
• Demonstrated ability to interact effectively with the company’s leadership / executive team
• Proficient with Microsoft Office Suite or related software, as well as HRIS and talent management systems. Experience with TriNet PEO systems preferred.

• Experience in the administration of benefits and compensation programs and other Human Resources programs.
• Evidence of the practice of a high level of confidentiality.
• Excellent organizational skills with attention to detail
• Strong sense of ethics.
