GENERAL SUMMARY:
The attorney is this position is responsible for the prosecution of DUI, misdemeanor, traffic case files, and misdemeanor cases dealing with domestic violent crimes. This Misdemeanor ASA is responsible for working a status call, preparing cases for motion hearings, bench and jury trials.
PRINCIPAL DUTIES AND RESPONSIBILITIES:
1. Prosecute Misdemeanor cases
2. Review the defendant’s criminal history, then make appropriate bond recommendations based on office guidelines, public safety and in the interest of justice.
3. Prepare cases for trial, as well as hearings on various issues
4. Prepare all jury instructions prior to the date of the Jury trial.
5. Be willing and able to work into the evening hours on dates with Jury trials, or as other workload dictates.
6. Collaborate with victim rights advocates, and victims of domestic violence, to preserve and properly prepare the presentation of evidence at trial
7. Offer support and services to victims to ensure their safety
8. Support and work with domestic violence service providers by monitoring the progress of court ordered offender counseling
9. Assist Police Officers in coordinating investigations
10. Conduct hearings on motions seeking orders of protection
11. Research issues related to domestic violence
12. Conduct Grand Jury proceedings to seek indictments on domestic related crimes, when enhancements are appropriate
13. Liaison to various State and County agencies that deal with domestic violence in Kane County
14. Work the DUI status call by working at the bench, working with defense attorneys, or any other courtroom work as needed.
15. Make offers on DUI cases, preferably within one court date of the defendant’s first appearance. Give acceptance deadline dates on all offers made.
16. Notify supervisor of any felony eligible DUI cases.
17. On cases in which a defense attorney is requesting a reduction of charges, fully complete the reduction request form and review the case with the Deputy Chief of the Criminal Division. Inform defense counsel of the Deputy Chief’s decision prior to the next status date.
18. File petitions to revoke on post-plea DUI and misdemeanor cases.
19. Motion up cases with PTRSSS filings for motion setting.
20. Subpoena witnesses for any motions to quash, petition to rescind statutory summary suspension hearing, bench trial, jury trial or other court hearing on a timely basis within 48 hours of the hearing being set.
21. Conduct any necessary legal research well in advance of any set motion hearing or trial. Review file in advance to determine legal issues, and/or any factual problems.
22. Conduct all work necessary to successfully present the State’s case in bench and jury trials.
23. Contact witnesses in advance of hearing or trial date to ensure court appearance, and to prepare witnesses for their court appearance.
24. Return phone calls to defense attorneys, police, and civilian witnesses within 24 hours, or as directed by office policy.
25. Make sure support staff has called off witnesses on cases no longer going to trial.
26. Complete any other assignments as directed by the Deputy Chief of the Criminal Division, the Chief of the Criminal Division, the First Assistant, or the State’s Attorney.

KNOWLEDGE, SKILLS AND ABILITIES REQUIRED:
1.) A J.D. degree and valid Illinois law license.
2.) Ability to conduct legal research including use of Lexis.

and defense bar, and all MDT members
4.) Must be able to work in a team environment
5.) Strong organizational skills.
6.) Ability to work in a multi-task environment.
7.) Ability to prioritize tasks.
8.) Professional verbal and written communication skills required.
9.) Must be able to work weekends as needed.
