The State of New Hampshire, Department of Labor, Division of Inspection has a full time vacancy for a Labor Inspector.
Summary:
Conducts specialized inspections of public and private sector worksites to enforce labor laws to insure compliance with RSA 275, 275 A, 275 E, 276 A, 277 B, 279, 157 A, 157 B, 281 A. Audits payroll and employee records to determine compliance with laws and administrative rules pertaining to youth employment, whistleblowers protection, minimum wage, protective legislation, citizen job protection, boiler and elevator inspection certification, workers’ compensation, public employee safety and health. Evaluates findings in establishments in order to formulate recommendations to bring work facilities into compliance with NH state labor laws. Works under the direction of the wage and hour supervisor.
Responsibilities:
Conducts inspections to ensure compliance with NH state labor laws at public and private entities including but not limited to commercial, service, manufacturing, retail, wholesale, recreational, seasonal, cities, towns and school districts. Inspections are of a specialized nature and will include the examination of payroll records, timecards, cancelled checks, employee files and insurance documents.
Utilizes laptop computer to write reports of employer audits as well as processing in house data. Electronic filing of time sheets, schedules, and complaints from the public. Possesses computer knowledge of electronic imaging of files View Star, NH Department of Labor’s AS400 database and website.
Coordinates procedures to administer oaths, serve summonses and subpoenas. Testifies in administrative hearings and or judicial proceedings in representing the NH Department of Labor.
Examines and audits records and accounting documents to determine violations of improper hours paid, overtime hours due, illegal wage deductions; calculates any necessary wage adjustments; demands payment of wages due employees; collects fees and penalties due the Department of Labor.
Conducts investigations relative to complaints against employers to determine accuracy of records. Interviews employer and employees to determine validity of complaint. Compiles field data as a result of investigations and determines a course of action to be followed by employer.
Calculates and recovers wages due for current and former employees.
Coordinates and presents informational programs and seminars to educate selected industries, civic groups and educators relative to labor laws. Conducts training sessions to issuing officers of youth employment certificates to ensure that correct procedures are adhered to regarding the employment of minors.
Compiles field data and prepares reports to provide for the resolution of workers’ compensation claims.
Examines inspection reports and or certificates for boilers and unfired pressure vessels, elevators, escalators, and accessibility lifts to ensure the currency and proper posting of documents.
Makes status determination of state statutes relating to the NH Department of Labor.
MINIMUM QUALIFICATIONS:
Education: Bachelor’s degree or its equivalent from a recognized college or university with major study in business administration or industrial relations, or a related field. Each additional year of approved formal education may be substituted for one year of required work experience.
Experience: Five years’ experience in finance, business, manufacturing industries, or in the building construction fields, which can include worker’s compensation, employment law, protective legislation, labor compliance, communications, safety and health, boiler or elevator inspection or other related experience. Each additional year of approved work experience may be substituted for one year of required formal education.
License/Certification: Possession of a valid drivers’ license.
SPECIAL REQUIREMENTS:
1. Selected candidate will undergo a criminal and motor vehicle record check in order to ensure suitability for exposure to confidential information.
2. Must possess knowledge of State and Federal labor laws, court practices and procedures, and business practices and procedures.
3. Must be able to communicate effectively and work under adverse conditions.
4. Must be able to drive and walk for long periods of time.
5. Must be able to communicate effectively in both English and Spanish.
